A. TERMS OF USE OF THE KARIBU ANIMAL TRAIL
1. ACCEPTANCE OF TERMS
1.1 Your access to and use of KARIBU Animal Trail website ("the Website") and any Services referred to in Clause 2, is subject exclusively to these Terms and Conditions. You will not use the Website/Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Website/Services you are fully accepting the terms, conditions and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Website/Services.
1.2 We reserve the right to update or amend these Terms and Conditions at any time and your continued use of the Website/Services following any changes shall be deemed to be your acceptance of such change. It is therefore your responsibility to check the Terms and Conditions regularly for any changes.
2. THE SERVICES
The Website may provide communication tools such as email, bulletin boards, news groups, forums and/or other message or communication facilities ("the Services") designed to enable you to communicate with others. Unless stated otherwise the Services are for your personal and non-commercial use only.
3. CHILD SUPERVISION
We are concerned about the safety and privacy of our users, particularly children. Parents who wish to allow their children access to and use of the Website/Services should supervise such access and use. By allowing your child access to the Services you are allowing your child access to all of the Services, including email, bulletin boards, chat areas, news groups, forums and/or other message or communication facilities. It is therefore your responsibility to determine which Services are appropriate for your child. Always use caution when revealing personally identifiable information about yourself or your children via any of the Services.
4. ACCEPTABLE USE
4.1 In using the Website/Services you agree not to:
4.1.1 use the Services to send junk email, spam, chain letters, pyramid schemes or any other unsolicited messages, commercial or otherwise;
4.1.2 post, publish, distribute or disseminate material or information that is defamatory, infringing, obscene, indecent, threatening, abusive, harassing or unlawful;
4.1.3 post, publish, distribute or disseminate material or information that incites discrimination, hate or violence towards any person or group on account of their race, religion, disability, nationality or otherwise;
4.1.4 threaten, abuse, disrupt, stalk or otherwise violate the legal rights (including rights of privacy and publicity) of others;
4.1.5 use any information or material in any manner that infringes any copyright, trademark, patent or other proprietary right of any party;
4.1.6 make available or upload files that contain a virus, worm, trojan or corrupt data that may damage the operation of the computer or property of another;
4.1.7 collect or store personal information about others, including email addresses;
4.1.8 impersonate any person or entity for the purpose of misleading others;
4.1.9 violate any applicable laws or regulations;
4.1.10 use the Website/Services in any manner that could damage, disable, overburden or impair the Website/Services or interfere with any other party’s use and enjoyment of the Website/Services;
4.1.11 post, publish, distribute or disseminate material or information that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information or confidential information disclosed in the course of employment or under a confidentiality agreement);
4.1.12 attempt to gain unauthorised access to any of the Services, other accounts, computer systems or networks connected to the Website/Services through hacking, password mining or any other means.
4.2 We have no obligation to monitor the Services but shall be entitled to review materials posted to a communications facility and, at our sole discretion, to remove any material that breaches these Terms and Conditions or is otherwise objectionable.
5. TERMINATION
We have the right to terminate your access to any or all of the Services at any time, without notice, for any reason, including without limitation, breach of these Terms and Conditions. We may also at any time, at our sole discretion, discontinue the Website/Services or any part thereof without prior notice and you agree that we shall not be liable to you or any third party for any termination of your access to the Website/Services.
6. LINKS TO THIRD PARTY WEBSITES
The Website/Services may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that KARIBU Animal Trail is not responsible for the content or availability of any such sites.
7. INTERNATIONAL USE
You agree to comply with all applicable laws regarding the transmission of technical data exported from Tanzania or the country in which you reside (if different) and with all local laws and rules regarding acceptable use of and conduct on the Internet.
8. INDEMNITY
You agree to indemnify and hold KARIBU Animal Trail and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against KARIBU Animal Trail arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
9. SEVERANCE
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

B. TERMS AND CONDITIONS OF SALE OF THE KARIBU ANIMAL TRAIL SHOP
The Customer also declares that he has the legal capacity to undertake as provided in these general conditions.
1. OBJECT
These general terms and conditions of sale have the object of defining the rights and obligations of the parties in the context of distance selling of goods provided in the on-line KARIBU Animal Trail shop.
2. COVERAGE OF THE OFFER
This version of the General Terms of Sale refers to all the online sales made to the Customers.
3. ORDER RECEPTION
Any order confirmation signed by the validation click is an irrevocable commitment of the Customer, which can be revoked only in the cases provided by this contract in the article “Rejection right/returns” and “Order processing”.
4. ORDER ACCEPTANCE
The conclusion of the contract will only be effective upon confirmation of the order by KARIBU Animal Trail
The Customer will receive by email a receipt notification confirming the order, with all the elements of the contract (including ordered items, prices, potential delivery dates, shipping costs).
KARIBU Animal Trail, reserves the possibility of not confirming an order for any reason, especially if related to a product supply issue or to a problem related to the order received.
KARIBU Animal Trail cannot be held liable for delivery errors due to inaccuracies or incompleteness in filling out the purchase order by the Customer.
KARIBU Animal Trail shall also not be held liable for any damage that may have occurred to the products after delivery to the carrier responsible for their carriage, nor for delays in delivery caused by the carrier.
5. PRODUCTS AVAILABILITY
The offers on our online shop will be valid until the listed items are available.
KARIBU Animal Trail, reserves the right to inform the Customer, within 7 days from the purchase, through the e-mail address associated with their profile, any unavailability of one or more of the purchased items.
KARIBU Animal Trail will reimburse (on the credit card or Pay-Pal account used for the purchase) the purchase cost and shipping costs incurred by the Customer.
The unavailability of one or more of the ordered items will not, however, give the customer the right to cancel the entire order.
6. PRICE-RECEIPT
The price guaranteed to the buyer is the one posted on the shop at the time of purchase. Product prices are final.
The receipt will be enclosed in the package and/or shared by carrier upon delivery.
7. PAYMENT
The Customer intending to make a purchase must complete the online order in the website dedicated section, where, following the procedures indicated therein, he will confirm his order and make the payment. The payment is due at the time of the purchase.
The Customer agrees to pay the price for the product ordered on the website (including shipping costs) through the available payment methods.
The Customer declares that he/she has all the necessary permissions to use the payment tool indicated when placing the order.
KARIBU Animal Trail reserves the right to cancel the order if does not receive the payment.
Payment on delivery is not allowed.
8. ORDER PROCESSING
The order will be processed upon acceptance of the order by KARIBU Animal Trail and in any case not later than the day following the confirmation of the order, subject to the availability of the ordered product and subject to a specific agreement between the parties. In case of unavailability of the ordered item, KARIBU Animal Trail is committed to inform the Customer as soon as possible, and will indicate any renewed availability deadline.
9. SHIPPING AND DELIVERY
The delivery area corresponds to the coverage area of the offering. The shipping cost will be specified from time to time at the end of the order.
Delivery to customers is carried out Monday through Friday via existing partnerships with several couriers. The order is to be processed within 48-96 hours and delivery is expected within 8-40 days dependent on the location of the customer. Customers can opt for express shipping through our e-mail info@ karibu-at.org. This process will attract additional shipping costs.
The products are delivered to the address indicated by the Customer.
KARIBU Animal Trail cannot be held liable for errors in delivery due to inaccuracies or incompleteness in filling out the shipping and delivery details by the Customer. KARIBU Animal Trail cannot be held responsible for any damage that may have occurred to the products after delivery to the carrier responsible for transporting them and for delays in delivery.
The delivery document issued by the carrier dated and signed by the Customer upon delivery of the product, will constitute a proof of transport and delivery of the goods. Upon delivery, the Customer must verify the content, compliance and status of the product. In the event of delays, failures, total or partial losses or other problems, it is the Customer’s right to file a complaint against the courier, without the liability of KARIBU Animal Trail , being ever taken into account.
Therefore, upon delivery, KARIBU Animal Trail recommends that the customer reviews the conditions of the products before signing the receipt. In case of anomalies, the Customer must refuse delivery of the products or write down their detailed terms.
10. RISK OF LOSS OR DAMAGE
Risk of loss or damage passes to buyer upon delivery to the carrier.
During the rejection period referred to in Article 11, of the Returns Policy, the Customer is responsible for the item. In case of damage or destruction of the product during Customer custody, the latter will face all the consequences.
11. REJECTION RIGHT/RETURNS
The Customer has the right to terminate the Contract without penalty and without specifying the reason, from the receipt of the order confirmation sent by KARIBU Animal Trail, no later than 7 working days after receipt of the product at the address indicated for delivery. The date on the delivery receipt is full proof of receipt of the product by the Customer. The Customer can notify KARIBU Animal Trail, of his/her rejection choice through the e-mail address: info@karibu-at.org.
If the product has already been delivered, the customer is required to return it to KARIBU Animal Trail.
To that end:
– the deadline for returning the product is fourteen(14) days after product delivery; the date on the delivery receipt is the one taken into consideration. The product will be considered returned when delivered and accepted by the local Post Office under registered mail.
If the product has been delivered, the substantial integrity of the product is a requirement for it to be returned. The Customer must send the product properly packed; KARIBU Animal Trail, does not accept damaged returns, but only items kept in normal state of preservation.
Products that are damaged by detergents/ additives or products damaged by the Customer will not be replaced nor refunded. The Customer must place a copy of the delivery document inside the return box. The transportation risks for the return of the products are entirely borne by the Customer.
– The costs for returning the items to KARIBU Animal Trail are responsibility of the Customer. If the Customer returns an item in accordance with the provisions of these conditions of sale, KARIBU Animal Trail, will reimburse the sums paid by the Customer on the credit card or Pay Pal account or through the bank details provided by the Customer.
